Chapter 1: General Provisions
Article 1 [Purpose)
These terms and conditions are intended to regulate the conditions, procedures, and other necessary matters regarding the use of the website (hereinafter referred to as the “Service”) provided by the National Institute of Oriental Medicine (hereinafter referred to as “NIKOM”).
Article 2 (Validity and Change of Terms and Conditions)
1. Our site posts the contents of these terms and conditions, address, contact information for the person in charge (telephone number, e-mail address, etc.) on the initial service screen (front page) of our site so that users can view them.
1) When our site revises the terms and conditions, we will post the effective date and reason for revision on the home screen of our site along with the current terms and conditions from 7 days prior to the effective date until the day before the effective date.
2) The Korea Institute of Oriental Medicine may change these terms and conditions if there is a reasonable cause, and if the terms and conditions are changed, it will be announced without delay through “Notices.”
2. Our site will provide you with services on the condition that you agree to the terms and conditions of this agreement. If you agree to the terms and conditions of this agreement, these terms and conditions will be applied preferentially to our site's service provision and your use of the service.
3. By agreeing to these terms, you agree to visit the website regularly to check for changes to the terms. Our site is not responsible for any damages suffered by users due to lack of information on changed terms.
4. If a user does not agree to the changed terms and conditions, he or she may request withdrawal (cancellation) of membership. If he or she continues to use the service without expressing objection after 7 days from the effective date of the changed terms and conditions, he or she will be deemed to have agreed to the changes in the terms and conditions.
Article 3 (Rules other than terms and conditions)
Matters not specified in these Terms and Conditions shall be governed by the provisions of the Framework Act on Telecommunications, the Telecommunications Business Act, the Information and Communications Ethics Committee Deliberation Regulations, the Information and Communications Ethics Code, the Program Protection Act, and other relevant laws and regulations.
Article 4 (Definition of Terms)
The terms used in these Terms and Conditions are defined as follows:
1. User: A person who receives services provided by this site in accordance with these Terms and Conditions.
2. User Agreement: This refers to the agreement made between our site and the user regarding the use of the service.
3. Registration: An act of completing a service use agreement by filling out the relevant information in the application form provided by our site and agreeing to these terms and conditions.
4. Member: A person who has registered as a member by providing the personal information required for membership on our site and who can use the information and services of our site.
5. User Number (ID): This refers to a combination of letters and numbers selected by the user and provided by our site for the purpose of identifying the user and allowing the user to use the service.
6. Password (PW): A combination of letters and numbers selected by the user to verify the user's identity as the registered member and to protect the user's personal information during communication.
7. Withdrawal (Cancellation): An act by which a member terminates the service agreement.
8. Terms not defined in these Terms and Conditions are defined in the separate Terms and Conditions and Terms of Use for each service.
Article 5 (Establishment of Use Agreement)
1. The service agreement is established upon our website’s approval of the user’s application for use.
2. Agreement to these Terms of Use is indicated by clicking the 'Agree' button on the relevant website at the time of application for use.
Article 6 (Membership Registration and Withdrawal)
1. Membership registration is completed when the applicant fills in the required information in the membership application form provided on our website online.
2. Our site may cancel membership registrations that fall under any of the following categories.
1) When applying using another person’s name
2) When the information in the membership application form was false or was submitted falsely
3) When the application is made for the purpose of disturbing the peace and order of society or public morals.
4) When you interfere with another person's use of our website services or steal information, etc.
5) If you use our site to commit acts prohibited by laws and these Terms and Conditions
6) When the membership requirements set by the other party site are not met
3. If you no longer wish to receive the services provided by our site after registering as a member, you may withdraw (cancel) your membership at any time.
4. The user ID may be changed at the request of the user or the company in the following cases.
1) If the user ID is registered with the user's phone number or resident registration number, there is concern about privacy infringement.
2) If it causes disgust in others or goes against good morals and manners.
3) In case there are other reasonable grounds
5. The user is responsible for managing the service user ID and password. The user is responsible for any damages incurred while using the service due to negligence in managing the ID and password or for any unauthorized use by a third party, and this site bears no responsibility for such damages.
6. Other matters related to the management and change of personal information of users are subject to the provisions of this site.
Article 7 (Consent to Use Member Information)
1. Our site's privacy policy applies to your personal information.
2. If you apply to use our site in accordance with these Terms and Conditions, you are deemed to have agreed to our site collecting and using the member information stated in the application in accordance with these Terms and Conditions and the Privacy Policy.
Article 8 (User Information Security)
1. From the moment you complete the registration process for our site service, you are responsible for maintaining the confidentiality of the information you entered, and you are responsible for all consequences arising from the use of your ID and password.
2. You are responsible for all management of your ID and password. If you discover that your ID or password has been used illegally, you must immediately report it to our site. You are responsible for all liabilities arising from failure to report.
3. Users must log out accurately each time they finish using our site's services. If you do not log out and a third party steals your information, our site will not be held responsible for any damages or losses that may arise.
Article 9 (Service Usage Time)
1. In principle, the service is available 24 hours a day, 365 days a year, unless there are special business or technical issues on our site.
2. The days or times set by our site for reasons such as regular inspections during the usage time in Paragraph 1 are exceptions.
Article 10 (Notice of suspension and suspension of service)
1. If the contents of messages and other communication messages stored or transmitted on your site service are not stored or deleted, are not transmitted, or other communication data is lost due to a national emergency, power outage, service equipment failure beyond the management scope of our site, or other force majeure, our site shall not be held liable.
2. If our site must temporarily suspend service due to difficulties in providing normal service, we may suspend service after posting the reason and time of suspension on the homepage one week in advance of the suspension, and our site shall not be held responsible for your failure to recognize the notice during this period. In case of unavoidable circumstances, the above-mentioned advance notice period may be shortened or omitted. In addition, our site shall not be held responsible for cases where the contents of messages or other communication messages stored or transmitted on this service are not stored or deleted, not transmitted, or other communication data is lost due to the above-mentioned suspension of service.
3. If the service must be permanently discontinued due to circumstances on our site, it will be in accordance with Article 2. However, in this case, the advance notice period will be 1 month.
4. Our site may temporarily modify, change, and suspend the service after prior notice, and we shall not be liable to you or any third party for this.
5. Our site may temporarily suspend services without prior notice due to unavoidable reasons such as urgent system inspection, expansion, and replacement, and may completely suspend services currently provided for reasons deemed appropriate by our site such as replacement with a new service.
6. If the Site is unable to provide normal services due to a national emergency, power outage, service equipment failure, or service usage overload, the Site may restrict or suspend all or part of the services. However, in this case, the reason and period will be notified to users in advance or after the fact.
7. In the event of a service interruption due to reasons beyond the control of the Site (disk failure, system downtime, etc. not caused by the intentional or negligent actions of the system administrator), the Site cannot provide prior notice, and in the event of a system interruption due to the intentional or negligent actions of others (PC communication companies, telecommunication service providers, etc.), no notice will be given.
8. If you act in violation of the terms and conditions of this site, our site may restrict or suspend your use of the service or terminate the service agreement without your consent. In this case, our site may prohibit the user from accessing the site.
Article 11 (Provision of information and posting of promotional materials)
1. When operating the service, our site may provide you with various information by posting it on the homepage or sending it via e-mail or postal mail.
2. Our site may post promotional materials that are deemed appropriate for the service or are of public interest.
Article 12 (Management and operation of posts on our site)
1. You retain the rights to the content of the posts you post.
2. Our site reserves the right to edit or move posted content without prior notice, and may delete content without prior notice in the following cases.
1) If you post a post that violates these Terms of Service or is judged to be commercial, illegal, obscene, or vulgar.
2) If the content defames or slanders other members or third parties and damages their reputation.
3) In case the content violates public order and morals.
4) If the content is deemed to be related to criminal activity.
5) If the content infringes on the copyrights or other rights of a third party
6) In case of violation of other related laws and regulations
3. You are solely responsible for any civil or criminal liability arising from your posting infringing upon the copyrights of others.
Article 13 (Restrictions on Service Use)
1. If the information you provide is found to be false or there is reasonable cause to suspect that it is false, our site may partially or completely suspend your use of this service and will not be held liable for any disadvantages arising therefrom.
2. If you act in violation of the provisions of these Terms and Conditions, including Article 15 (Member Obligations), our site may restrict or suspend your use of the service at its discretion. In this case, our site may prohibit your access.
Article 14 (Obligations of our site)
1. Our site shall not engage in any acts prohibited by laws and regulations or these Terms and Conditions or that are against public morals, and shall endeavor to provide services continuously and stably.
2. Our site does not disclose or distribute members' personal information to others without their consent. However, this does not apply in cases where there is a request from a government agency or other relevant law pursuant to the Telecommunications Act or other relevant laws.
3. Our site must have a security system to protect users’ personal information (including credit information) so that users can safely use our site services.
4. Our site is not responsible for any service disruption caused by the user's fault.
Article 15 (Members’ Obligations)
1. The information requested when registering as a member must be entered accurately. In addition, the information already provided about you must be maintained and updated to ensure that it is accurate, and members must not allow third parties to use their ID and password.
2. Members may not engage in any commercial activities using the service without prior approval from our site.
3. Members may not copy, reproduce, modify, translate, publish, broadcast or otherwise use information obtained through the use of our site services or provide such information to others without the prior consent of our site.
4. Members must not perform any of the following acts in relation to the use of our site services. If this is violated, our site may arbitrarily terminate membership without prior warning.
1) Act of stealing and using another member's password and ID illegally
2) Transmitting, posting, publishing, e-mailing or otherwise transmitting content that is vulgar, obscene, insulting, threatening or may infringe on the privacy of others.
3) Acts of disguising the source of content transmitted through the service
4) Posting, publishing, e-mailing or transmitting by other means any content that cannot be used by law or contract.
5) Posting, publishing, sending by e-mail or other means any content that infringes on another person's patent, trademark, trade secret, copyright or other intellectual property rights.
6) Posting, publishing, e-mailing or transmitting any advertisements, promotional materials, spam mail, chain letters, pyramid schemes or other forms of solicitation without the approval of our site.
7) Collecting or storing personal information of other users
8) Acts intended for criminal activity or related to other criminal activities
9) Acts that harm good customs and other social order
10) Acts that defame or insult others
11) Acts that infringe upon the intellectual property rights of others
12) Hacking or distributing computer viruses
13) An act of continuously transmitting certain content, such as advertising information, against the will of others.
14) Any action that may interfere with or hinder the safe operation of the service.
15) Changes to information posted on our site.
16) Other acts that violate Article 53, Paragraph 1 of the Telecommunications Business Act and Article 16 (Unwelcome Communications) of the Enforcement Decree of the Telecommunications Business Act
Article 16 (Ownership of our Site)
1. The intellectual property rights and other rights related to the services provided by our site, the necessary software, images, marks, logos, designs, service names, information, and trademarks are owned by our site.
2. Except as expressly permitted by our site, you may not modify, rent, loan, sell, distribute, produce, transfer, sublicense, create a security interest in, or commercially use all or part of the properties specified in the preceding paragraph, and you may not permit third parties to do the same.
Article 17 (Prohibition of Transfer)
Members may not transfer or donate their right to use the service or other status under the service agreement to others, and may not provide this as collateral.
Article 18 (Compensation for Damages)
Our site is not responsible for any damages suffered by members in connection with services provided free of charge, except for criminal acts intentionally committed by our site.
Article 19 (Disclaimer)
1. If our site is unable to provide services due to natural disasters, war, or other similar force majeure, we will be exempt from responsibility for providing services.
2. Our site is exempt from liability if damage occurs due to the telecommunications service provider suspending or failing to provide telecommunications services normally.
3. Our site is exempt from liability for damages caused by unavoidable reasons such as maintenance, replacement, regular inspection, or construction of service equipment.
4. Our site is not responsible for damages caused by errors in the user's computer or damages caused by a member incorrectly entering personal information or email address.
5. Our site has no obligation to confirm or represent any opinions or information expressed in the service, and does not approve, oppose, or modify opinions expressed by members or third parties. Our site is not responsible for any profits or losses you may incur by relying on information contained in the service.
6. Our site does not assume any responsibility for any transactions of goods or money between members or between members and third parties through the service, and we do not assume any responsibility for any profits expected by members in relation to the use of the service.
7. Our site is not responsible for any loss or gain expected from using the service or any damage caused by information obtained through the service, and we are not responsible for the reliability or content of information, data, or facts posted by members on this service.
8. Our site is not responsible for any damages incurred by you in connection with the use of the service, including damages caused by your intent or negligence.
9. Our site does not guarantee the accuracy, completeness, and quality of the content of services provided by subscribers or other related organizations, not services provided by our site. Therefore, our site is not responsible for any kind of loss or damage that you may incur as a result of using the above content. In addition, our site is not responsible for compensating for any mental damage that users may incur due to other users while using the service.
* Supplementary Provision 1. (Enforcement Date) These Terms and Conditions shall be effective from 00/00/2007.
